1. Acceptance of Terms

Welcome to EatMe ("EatMe," "we," "our," or "us"). By downloading, installing, or using the EatMe mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and EatMe. Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

EatMe is a fast-paced cosmic arcade game where players control a hungry orb in a neon arena. The App provides:

• An arcade gameplay experience with drag-to-move controls
• 11 growth tiers and size-based progression
• Combo multiplier system up to x5 (GODLIKE)
• Power-ups including Life Boost, Score Burst, Mass Surge, and Energy Wave
• Collectible gems and unlockable player skins
• Detailed game statistics and personal best tracking
• Optional rewarded video ads for "Second Chance" feature
• Optional in-app purchases

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device(s) solely for your personal, non-commercial use.

You may NOT:

• Modify, reverse engineer, decompile, or disassemble the App
• Copy, distribute, or create derivative works from the App
• Remove or alter any proprietary notices or labels on the App
• Use the App for any commercial purpose without our express written permission
• Use cheats, exploits, automation software, bots, hacks, or mods
• Manipulate scores, gems, or unlocks through unauthorized means

4. User Accounts

EatMe does not require user accounts, registration, or login credentials. All game functionality is available immediately upon installation without providing any personal information. Game progress is stored locally on your device.

5. In-App Purchases and Virtual Currency

EatMe may offer optional in-app purchases and uses an in-game virtual currency (gems).

• All monetary purchases are processed through the Apple App Store
• Prices are displayed in the App Store and may vary by region
• Purchases are generally non-refundable except as required by law or Apple's refund policy
• For refund requests, contact Apple Support directly
• Gems earned through gameplay are free and have no real-world monetary value
• Virtual items and skins are licensed, not sold, and may be modified or removed in future updates
• We reserve the right to modify pricing, gem earning rates, or available items at any time

6. Rewarded Advertisements

EatMe includes optional rewarded video advertisements (e.g., the "Second Chance" feature). By using this feature, you understand that:

• Watching ads is entirely voluntary and never required to play
• Ads are provided by third-party advertising partners
• Ad content is controlled by the ad partner, not by EatMe
• We are not responsible for the content, accuracy, or opinions expressed in advertisements
• Ad availability may vary by region and is not guaranteed
• You may limit ad personalization through iOS privacy settings

7. Game Content and Fairness

EatMe is a single-player arcade experience. You acknowledge that:

• Game difficulty, enemy behavior, and power-up spawning involve randomness
• Scores depend on skill, strategy, and some degree of luck
• We may adjust game balance, difficulty, scoring, or mechanics in updates
• Progress, scores, and unlocks are stored locally and may be lost if the app is uninstalled or device data is lost
• We are not responsible for lost progress due to device failure, OS updates, or accidental deletion

8. User Conduct

You agree NOT to:

• Use cheats, exploits, or hacks to manipulate game outcomes or scores
• Use automation software, bots, or scripts to play the game
• Attempt to manipulate in-app purchases or gem counts through unauthorized means
• Reverse engineer game mechanics for the purpose of creating competing products
• Distribute, share, or sell cheats, hacks, or exploits for the game
• Use the App in any way that violates applicable laws or regulations

9. Intellectual Property Rights

The App and all its contents, features, and functionality — including all game art, animations, sound effects, music, code, text, graphics, skins, and the selection and arrangement thereof — are owned by EatMe, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

The EatMe name, logo, game characters, and all related names, logos, product and service names, designs, and slogans are trademarks of EatMe. You may not use such marks without our prior written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, EATME DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• That the App will be uninterrupted, timely, secure, or error-free
• That game performance will be consistent across all devices
• That defects will be corrected
• That the App is free of bugs or other harmful components

EatMe is an entertainment product. We make no guarantees about specific gameplay experiences.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EATME, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of game data, progress, scores, gems, or unlocked skins
• Loss of enjoyment or entertainment value
• Frustration from game difficulty or mechanics
• Device performance issues related to the App
• Issues with third-party advertisements

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless EatMe and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms
• Your use of cheats, hacks, or exploits
• Your violation of any applicable laws or regulations

13. App Updates and Modifications

We may update, modify, or discontinue the App (or any part thereof) at any time without notice. Updates may change game mechanics, balance, visual elements, available skins, scoring, or other features. We are not liable for any changes to the game experience resulting from updates.

14. Platform Requirements

EatMe is available for iOS devices. You are responsible for:

• Owning a compatible iOS device
• Maintaining an updated operating system
• Having sufficient storage for the app and game data

Game performance may vary depending on device model and available resources. We do not guarantee optimal performance on all supported devices.

15. Termination

You may terminate your use of the App at any time by deleting it from your device. We reserve the right to discontinue the App or any of its features at any time. All provisions of these Terms that by their nature should survive termination shall survive.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration. You agree to waive any right to a jury trial or to participate in a class action.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide notice through an App Store update. By continuing to use the App after revisions become effective, you agree to be bound by the revised terms.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EatMe regarding the use of the App.

21. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING EATME, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
